Mens rea is the mental element. The highest level is intention. Direct intent occurs where it is the defendant’s purpose or aim to bring about the prohibited consequence. Oblique intent arises under the virtual certainty test established in R v Woollin: a jury may find intention where the consequence was a virtual certainty of the defendant’s actions and the defendant appreciated that fact.

The duty is to take such care as is reasonable in all the circumstances to see that the trespasser does not suffer injury on the premises by reason of the danger concerned (s.1(4)). Warnings may discharge the duty.
