For precedent, know the difference between ratio decidendi and obiter dicta, and be able to explain how the Supreme Court can depart from its own decisions using the Practice Statement 1966.

For actus reus, be prepared to explain conduct, consequences and circumstances, including omissions liability. For mens rea, focus on intention (direct and oblique) and recklessness (subjective Cunningham test). Be ready to illustrate each concept with a case such as R v Mohan for direct intent and R v Cunningham for recklessness.

Battery is the actual infliction of unlawful force. Assault occasioning actual bodily harm (ABH) under s.47 OAPA 1861 requires proof of an assault or battery that causes ‘actual bodily harm’. These are all basic-intent crimes.

Be critical about the householder provisions that allow disproportionate force in certain home-invasion scenarios.

Evaluation points could include the outdated nature of the M’Naghten rules and the policy limits on duress for murder.

Revise breach by focusing on the reasonable person standard, the factors from Blyth v Birmingham Waterworks, and the idea of risk factors such as the likelihood of harm, the seriousness of harm and the cost of precautions.

For evaluation, discuss the fairness of imposing liability for pure economic loss in limited circumstances and the impact of nervous shock claims.

Understand the difference between executed, executory and past consideration.

Draw flowcharts to map out the sequence of a contract formation problem question.

Practise explaining how these grounds provide a check on executive power, and evaluate the limits, such as the difficulty of proving irrationality under the Wednesbury test.
