Act – a law passed by Parliament, after being approved by both the House of Commons and the House of Lords, and receiving Royal Assent.

Statute – another word for an Act of Parliament; a written law.

Parliamentary sovereignty – the principle that Parliament is the supreme law-making body and can make or repeal any law. No other body can override its legislation.

Judicial precedent – a source of law where past decisions of judges create law that must be followed in future similar cases.

Murder – the unlawful killing of a human being under the King’s peace with the intention to kill or cause grievous bodily harm.

Manslaughter – the unlawful killing of a person without the intention to kill, for example through gross negligence or in the heat of passion (voluntary manslaughter).

Theft – the dishonest appropriation of property belonging to another with the intention of permanently depriving the other of it.

Battery – the actual infliction of unlawful personal violence on another person, such as a punch or a slap.

Actual bodily harm (ABH) – an assault or battery that results in some injury, however minor, such as bruising or a scratch.

Grievous bodily harm (GBH) – really serious harm, such as broken bones or permanent disfigurement. Requires a more severe sentence.

7. Defences in Law | 法律抗辩

Self-defence – the use of reasonable force to protect oneself, another person, or property from an imminent threat. The force must be proportionate to the threat.

Duress – a defence based on the defendant being forced to commit an offence because of a threat of death or serious violence to themselves or someone close to them.

Necessity – a defence that argues the defendant had to commit the offence to avoid a greater evil, such as breaking a speed limit to save a life. It is rarely accepted.

Insanity – a defence based on the defendant having a defect of reason caused by a disease of the mind, which meant they did not know the nature and quality of the act or that it was wrong.

Automatism – a defence that the defendant’s action was an involuntary physical movement caused by an external factor, such as a blow to the head, and they were not in control.

Intoxication – being under the influence of alcohol or drugs. Voluntary intoxication is rarely a defence, but involuntary intoxication (e.g. drink was spiked) may be a defence to specific intent crimes.

8. Principles of Justice | 司法公正的基本原则

Presumption of innocence – the principle that a defendant is considered innocent until proven guilty. The prosecution must prove guilt beyond reasonable doubt.

Burden of proof – the obligation to prove the facts in a case. In criminal cases, the burden lies with the prosecution. In civil cases, it generally lies with the claimant.

Standard of proof – the level of evidence required to win a case. In criminal law, it is ‘beyond reasonable doubt’. In civil law, it is ‘on the balance of probabilities’.

Right to a fair trial – guaranteed under Article 6 of the ECHR, which requires an independent and impartial tribunal, public hearing, and adequate time to prepare a defence.

Double jeopardy – the rule that a person cannot be tried twice for the same offence after being acquitted. Exceptions now exist for serious offences where new and compelling evidence emerges.

Green Paper – a consultation document published by the government setting out proposals for new law and inviting public comment.

White Paper – a document setting out the government’s firm proposals for legislation after consultation. It often forms the basis of a Bill.

First Reading – the formal introduction of a Bill into Parliament, where its title is read out. No debate takes place.

Report Stage – the House reviews the amended Bill and decides whether to accept or reject the changes.

Third Reading – the final chance for the House to debate the amended Bill. No further amendments can normally be made.

三读 – 全院就修订后的法案进行最后辩论的机会。通常不能再提出修正案。

Royal Assent – the formal approval of a Bill by the monarch, which turns it into an Act of Parliament. In modern times, this is a formality.

10. Trial Procedures and Key Phrases | 审判程序与重要用语

Verdict – the decision of a jury on whether the defendant is guilty or not guilty in a criminal trial.

Sentence – the punishment given by a judge to a defendant who has pleaded guilty or been found guilty.

量刑 – 法官对已认罪或被定罪的被告判处的刑罚。

Bail – the temporary release of an accused person awaiting trial, sometimes with conditions such as reporting to a police station or providing money as security.

Plea – the defendant’s formal response to a criminal charge: guilty, not guilty, or no plea (where the court treats it as not guilty).

Cross-examination – the questioning of a witness by the opposing side’s lawyer to test the reliability of the evidence given.

Hearsay – a statement made outside court that is repeated in court to prove the truth of the matter stated. Hearsay is generally not admissible in criminal trials.

Summing up – the judge’s review of the evidence and explanation of the law to the jury before they retire to consider their verdict.
