📚 Referendums and How They Are Used | 全民公投及其运用方式

Referendums are a key feature of the UK’s democratic machinery, allowing citizens to vote directly on a single political or constitutional question. For Edexcel A-Level Politics students, understanding why referendums are held, how they operate, and what they reveal about the UK constitution is essential.

1. Defining Referendums |

A referendum is a direct vote in which an entire electorate is asked to accept or reject a specific proposal. In the UK, referendums are usually consultative rather than legally binding, although their political authority can be enormous.

Referendums differ from elections because they ask a policy or constitutional question rather than choosing representatives. They are most often used for issues of major constitutional significance, such as devolution, electoral reform, or membership of the European Union.

The question on a referendum is normally framed as a binary choice, such as remain/leave or yes/no. This simplicity makes the result easy to report, but it can also mask much more complex underlying policy choices.

2. Direct Democracy and Representative Democracy |

The UK is primarily a representative democracy: citizens elect MPs who take decisions on their behalf. Referendums introduce an element of direct democracy by allowing citizens to decide a specific issue themselves.

Supporters see this as a way to reconnect the public with political decision-making, while critics argue it bypasses the deliberation and safeguards of representative institutions. The tension between these two models is central to the study of UK democracy.

In practice, the UK uses referendums only occasionally. This means the country remains predominantly representative, but direct democracy is available when Parliament decides that a public mandate is needed for a major constitutional change.

3. The Constitutional Position of Referendums in the UK |

The UK has no codified constitution, so the rules on referendums are set by ordinary Acts of Parliament. This means Parliament can choose whether to hold a referendum and whether to be bound by the result.

Because Parliament is sovereign, no referendum result can legally override Parliament unless Parliament has already legislated to give it binding effect. The 2011 AV referendum was unusual in being legally binding under the Parliamentary Voting System and Constituencies Act 2011.

Most UK referendums, including the 2016 EU referendum, have been legally advisory. However, governments have treated clear advisory results as politically binding, meaning that a vote in favour of change is normally implemented even though there is no legal obligation to do so.

The main UK-wide referendums have been 1975 EEC membership (67% stay), 2011 AV (67.9% no), and 2016 EU membership (51.9% leave). Devolved and regional referendums include 1997 Scottish and Welsh devolution, 1998 Northern Ireland Good Friday Agreement, and 2014 Scottish independence.

A notable earlier case was the 1979 Scottish devolution referendum, where although a narrow majority voted yes, the result failed to meet a threshold requiring 40% of the total registered electorate, so devolution did not go ahead until 1997.

These examples show that referendums in the UK have been used selectively, usually when a government wants to legitimise a major constitutional reform or settle a divisive national question. Turnout has varied widely, from about 34% in 1997 Welsh devolution to 84.6% in 2014 Scottish independence.

5. How a UK Referendum Is Called and Run |

A UK referendum is normally called by an Act of Parliament, which sets the question, the franchise, the date, and any spending limits or campaign rules. The Electoral Commission advises on the wording of the question to ensure clarity and neutrality.

Recent major referendums, such as the 2016 EU referendum, were regulated by the Political Parties, Elections and Referendums Act 2000 (PPERA), which provides for designated lead campaign groups and spending limits. This framework is designed to create a fairer campaign environment, although it cannot guarantee balance in media coverage or public debate.

Unlike many countries, the UK has no general requirement for a supermajority or a minimum turnout in referendums. The result is typically decided by a simple majority of those who choose to vote, which raises questions about the strength of the mandate when turnout is low.

6. Arguments for Using Referendums |

One major argument for referendums is that they enhance democratic legitimacy. A decision made directly by the people on a major constitutional question is difficult for politicians to overturn or ignore.

Referendums can also settle long-running political debates. For example, the 2014 Scottish independence referendum, despite a no vote, gave a clear mandate for Scotland to remain in the UK at that time, and the issue was largely taken off the immediate political agenda.

They can increase public participation and political education, as campaigns force politicians and voters to engage with detailed arguments on both sides. A well-run referendum can therefore strengthen civic engagement and make the electorate more informed about constitutional issues.

Referendums also provide a check on the executive and Parliament. Governments
